REGULAR MEETING

Present and voting were Judy McQuade, Chairman, Art Sibley, Vice Chairman, Kip Kotzan, regular member, Mary Stone, Secretary and Nancy Hutchinson, alternate

Case 14-19 – Scott & Kathleen Boulanger, 73 Portland Avenue

A Motion was made by K. Kotzan, seconded by A. Sibley to CONTINUE the public hearing on 73 Portland Avenue to the November 18, 2014 Regular Meeting. No discussion and a vote was taken:  In favor:  A. Sibley, J. McQuade, K. Kotzan, M. Stone, N. Hutchinson    In opposition:  Abstaining:  None   The motion passed unanimously. 5-0-0  

Case 14-23 – Thomas & Margaret Sullivan, 23 Brightwater Road

A Motion was made by M. Stone, seconded by K. Kotzan to GRANT the necessary variances as per plans submitted for the following reasons:  the proposal does reduce nonconformities, it does reduce lot coverage, it replaces an older dilapidated structure with a safer more modern structure that stays within the scale and character of the neighborhood.  The structure will be built to code and there is an existing hardship which justifies this request.  No discussion and a vote was taken:  In favor:  A. Sibley, J. McQuade, K. Kotzan, M. Stone, N. Hutchinson  In opposition:  Abstaining:  None   The motion passed unanimously. 5-0-0

Reasons to grant:  The building needs repair and the project is being downscaled on a small lot.  Existing nonconformities are being reduced and is within the intent of zoning.

Case 14-24 – Thomas Lally, 54 Sea Spray Road

A Motion was made by A. Sibley, seconded by M. Stone to GRANT the necessary variances as per plans submitted with the condition that it is being increased in size and will only be used for storage, it would not be used for additional habitation, sleeping areas or what have you.  It is a good solution for these type houses that have very little storage in them and no cellar.  Before building permits are issued plans should be submitted and reviewed by the Chairman to make sure they conform to the intent of the  motion.  One neighbor on the sideyard setback wrote a letter in favor.   No discussion and a vote was taken:  In favor:  A. Sibley, J. McQuade, K. Kotzan, M. Stone, N. Hutchinson  In opposition:  Abstaining:  None   The motion passed unanimously. 5-0-0

Case 14-25 – Umars, LLC, 281 Shore Road

A Motion was made by A. Sibley, seconded by M. Stone to CONTINUE the public hearing on Umars, LLC, 281 Shore Road to the NOVEMBER 18, 2014 Regular Meeting in order for the applicant to submit new plans.  No discussion and a vote was taken:  In favor:  A. Sibley, J. McQuade, K. Kotzan, M. Stone, N. Hutchinson    In opposition:  Abstaining:  None   The motion passed unanimously. 5-0-0  

Minutes

A Motion was made by K. Kotzan, seconded by A. Sibley to APPROVE the Minutes of the September 16, 2014 Regular Meeting, as submitted.  No discussion and a vote was taken:  In favor:  A. Sibley, J. McQuade, K. Kotzan  In opposition:  Abstaining:  M. Stone   The motion passed. 3-0-1

Adjournment

A Motion was made by A. Sibley, seconded by K. Kotzan to adjourn the October 21, 2014 Regular Meeting; no discussion and a vote was taken.  The motion to adjourn passed unanimously.  5-0-0    The meeting adjourned at 9:15 p.m.

The next Regular Meeting will be held on Tuesday, November 18, 2014
at 7:30 p.m. at the Town Hall.  The ZBA does not meet in August
